Yokohama Customs museum reopened

Zen International Patents and Trademarks Yokohama Customs museum reopened after renovation on March 12, 2017. The reovation was conducted to attract incresing foreign tourists and cruise ships which arrive and depart from the Port of Yokohama. In this museum, a section to introduce infringing imported goods has newly been establised. Fake brand goods, such as bags or shoes, have been exhibited to show the current condition of damage from infringement of intellectual property rights.

Number of injunctions on goods infringing intellectual property rights exceeded 20,000

Zen International Patents and Trademarks The number of import injunctions on goods to japan infringing intellectual property rights was 26,034 in 2016, exceeding 20,000 for 10 consecutive years. About 90% of these cases were related to import from China. The number of import injunctions on goods infringing trademark rights accounts for 98% or more of the total, and the number of goods infringing trademark rights accounts for 65% or more of the total. Maricar Co. was sued by Nintendo

Zen International Patents and Trademarks Do you know Maricar Co. in Japan? Maricar Co. is a japanese company offering Street Go-Karting Tour while dressed as Mario, Luigi, Peach and Toad. Maricar Co. also posted pictures of characters such as Mario on SNS. Nintendo claims that such actions constitute infringement of copyright and violation of the Unfair Competition Prevention Act in Japan.

JPO and SMEAJ will agreed to strengthen cooperation

Zen International Patents and Trademarks The Japan Patent Office (JPO) and the Small and Medium Enterprise Agency of Japan (SMEAJ) will strengthen collaboration in support of the acquisition and utilization of intellectual property rights of small and medium-sized enterprises (SMEs). Administrative agencies in Japan tend to be vertically segmented administrative system, but both organizations will organize cross-organizational support system around intellectual property rights. Through this collaboration, both organizations hope to support SMEs’ overseas development, technological innovation, creation and protection of regional brands, and lead to regional revitalization.

Intellectual property revenue in Japan is 36,077 million US$

Zen International Patents and Trademarks According to the report of global note, The revenue in japan by utilizing intellectual property such as patents and/or trademarks is 36,077 million US$. This amount is the second largest in the world next to the United States. The japanese government intend to increase this value.

The intellectual propety law was revised for TTP

Zen International Patents and Trademarks On December 9, 2016, the intellectual propety law was revised for Trans-Pacific Partnership (TPP). The points of this revised law is as follows: Extension of Exceptions to Lack of Novelty of Invention (patent law) Improvement of Extension system for the duration of patent (patent law) Introduction of minimum amount of damages (Trademark law) The points of caution is that the enforcement date of this revised law will be the effective date of the TPP.

Response period of notice of reasons for refusal

Zen International Patents and Trademarks According to PRESS RELEASE of Japan Patent Office, The operation concerning extension of the response period of the reasons for refusal in the patent application or trademark registration application has been changed.  A two-month extension of the response period is permitted with one request without reasonable grounds.  A further one month extension of the response period is permitted with the second request without reasonable grounds. Extension of the period up to three months is allowed.
