The First Decision to Allow Regisration of "color per se mark" in Japan

Japan Patent Office (JPO) issued a decision to register two trademarks which consists of combinations of colors on February 28, 2017. One trademark applicant is Seven-Eleven Japan Co.,Ltd. and the other is Tombow Pencil Co., Ltd. Please see the marks below.

Japanese trademark application no. 2015-30037 in the name of Seven-Eleven Japan Co., Ltd.

Japanese trademark application no. 2015-29914 in the name of Tombow Pencil Co., Ltd.
This is the first decision to allow regisration of "color per se mark" in Japan.
"Color per se mark" application has been accepted by JPO since April 1, 2015.
According to media reports, JPO puts a high value on the face that both marks have been used more than 30 years and well-known to the public.
